Many of our Estate Agency colleagues tell us that ahead of searching for a property it is not at all unusual for a prospective purchaser to have already appointed a Spanish Lawyer. Smart planning from the outset is a great idea and having their expertise “in your corner” is really useful.
What do I mean when I say “When seeking a Costa del Sol property would it help to have a Spanish Lawyer at your shoulder?” I don’t mean literally that your selected and trusted bi-lingual, experience-qualified and locally-based Spanish Lawyer (Abogado) is somehow sitting uncomfortably in the backseat of your chosen Estate Agent’s branded car. No, they’re too valuable for that and the importance of their role in your purchase cannot be overstated.

Buying a property on the western Costa del Sol (between Malaga/Marbella and Tarifa) can be one of the most rewarding investments you’ll ever make. But it’s also a process governed by Spanish law, local regulations, and administrative practices that often differ from those in your home country. Having a local Lawyer (Abogado) who specialises in property transactions at your side can make all the difference between a smooth, secure purchase and an expensive headache later on.
Your Abogado’s roles are various but at the very minimum they should:
Deliver Local Knowledge and Legal Clarity
Your Abogado ensures that the property you’re buying is free of legal issues — such as outstanding debts, planning irregularities, or ownership disputes. This is particularly important in Marbella, where historical planning inconsistencies have left some homes with unclear status.
Protect Your Deposit and Contract Terms
In Spain, once a private purchase contract (Contrato de Arras) is signed, you’re usually committed. Your Abogado will review or draft the contract to protect your deposit, ensure fair conditions, and make sure there are no hidden penalties. Navigate the Bureaucracy
From obtaining an NIE number to opening a Spanish bank account and handling tax declarations, a local Abogado knows exactly what needs to be done and when — saving you weeks of confusion and unnecessary delays.
Negotiate and Represent Your Best Interests
Estate Agents work for the seller. Your Abogado works for you. They can liaise with the notary, town hall, and even the seller’s representative to ensure your interests are fully protected at every stage.

Ensure Post-Completion Security
Even after completion, your Abogado will handle registration at the Land Registry, arrange for utilities to be transferred, and ensure you’re compliant with Spanish tax obligations — essential for non-resident buyers.
In brief: Having a carefully selected local Abogado “at your shoulder” means you’re never navigating blind. You benefit from local expertise, legal protection, and peace of mind from first viewing to final signature — allowing you to enjoy your new Costa del Sol home with complete confidence.
Many may think having an Abogado “at your shoulder” from the start of your property search is an expensive luxury. To be clear many Costa del Sol-based Abogados charge a buyer fees based on a percentage – usually 1% (plus local VAT) – of the agreed purchase price of the property being purchased. This will usually be paid at the completion of your purchase. Prior to completion, from your first viewings to moving in, the role of your Abogado is crucial. Aside from recommending that you don’t abuse their proactive approach, it is usual that payment for their services will follow completion.
