Here’s a detailed overview:
Definition
The CompraVenta is a notarized contract – in the form of a Deed – that formalizes the sale (vender)) and purchase (comprar) of a property, outlining the terms and conditions agreed upon by the buyer and seller.
Key Elements
Property Description: The contract includes a detailed description of the property, including its location, size, and characteristics.
Purchase Price: The contract states the purchase price, payment terms, and any conditions or contingencies.
Payment Method: The contract specifies the payment method, such as bank transfer or cash.
Transfer of Ownership: The contract confirms the transfer of ownership from the seller to the buyer.
Warranties and Representations: The seller provides warranties and representations regarding the property’s condition, ownership, and any outstanding debts or liens.
Notarization
The CompraVenta must be signed before a notary public (notario) in Andalucia, who:
Verifies Identity: The Notary verifies the identities of the buyer and seller.
Explains the Contract: The Notary explains the contract’s terms and conditions to both parties.
Witnesses Signatures: The Notary formally witnesses the signatures of the buyer and seller.
Registration
After signing the CompraVenta, the buyer must register – most likely undertaken by your trusted Spanish Abogado – the property in their name at the:
Property Registry (Registro de la Propiedad): To update the property’s ownership records.
Town Hall (Ayuntamiento): To notify the local authorities of the change in ownership.
The CompraVenta is a critical document in a Marbella real estate transactions, providing a clear and binding agreement between the buyer and seller.
